Welcome to SketchViz. These Terms of Service ("Terms") govern your access to and use of the SketchViz website, services, and applications (collectively, the "Service") provided by SketchViz ("we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

1. Description of Service

SketchViz is an AI-powered visualization studio that transforms SketchUp renders into photorealistic visualizations using artificial intelligence technology. The Service allows users to upload architectural renders and generate enhanced, photorealistic images.

2. Account Registration and Security

2.1 Account Creation

To access certain features of the Service, you must create an account by authenticating with Google OAuth. You agree to provide accurate, current, and complete information during the registration process.

2.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.

2.3 Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to:

  • Violation of these Terms
  • Fraudulent, abusive, or illegal activity
  • Extended periods of inactivity

3. Use of the Service

3.1 License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or internal business purposes.

3.2 Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose or in violation of any local, state, national, or international law
  • Upload or transmit any content that infringes upon the intellectual property rights of others
  • Upload malicious code, viruses, or any other harmful content
  • Attempt to gain unauthorized access to the Service or its related systems
  • Interfere with or disrupt the Service or servers or networks connected to the Service
  • Use the Service to generate content that is defamatory, obscene, pornographic, or otherwise objectionable

3.3 Credits System

Access to image generation features requires credits. You may purchase credits according to our pricing plans. Credits are non-refundable and non-transferable. We reserve the right to modify pricing at any time.

4. User Content

4.1 Ownership of Uploaded Content

You retain all ownership rights and intellectual property rights to the images you upload to the Service ("User Content"). By uploading User Content, you grant us a limited, non-exclusive, royalty-free license to process and temporarily store your User Content solely and exclusively for the purpose of providing the Service to you (i.e., generating your visualizations). We do not use, distribute, publish, or repurpose your User Content for any other purpose, including but not limited to training AI models, marketing, or sharing with third parties, except as necessary to provide the Service to you (such as transmitting images to Google Gemini for processing).

4.2 Ownership of AI-Generated Content

All images generated by the Service using AI technology ("Generated Content") belong to you. You own all rights, title, and interest in and to the Generated Content. We do not claim any ownership rights to Generated Content and do not use, distribute, publish, or repurpose your Generated Content for any purpose whatsoever.

However, you acknowledge that:

  • AI-generated images may not always be accurate or of the quality you expect
  • Generated Content is created by AI models and may incorporate patterns learned from training data
  • While you own the Generated Content, we cannot guarantee its uniqueness or originality due to the nature of AI generation
  • You are solely responsible for your use of Generated Content and ensuring it complies with applicable laws

4.3 Prohibited Content

You may not upload or generate content that:

  • Infringes on intellectual property rights
  • Contains personal information of third parties without consent
  • Violates any applicable law or regulation
  • Is intended to deceive or mislead others

4.4 Content Removal

We reserve the right to remove any User Content or Generated Content that violates these Terms or is otherwise objectionable, without notice.

5. AI Processing and Third-Party Services

5.1 AI Processing

The Service uses Google Gemini AI technology to process your images and generate photorealistic visualizations. By using the Service, you acknowledge and agree that:

  • Your uploaded images will be transmitted to Google's AI services for processing
  • The AI processing is subject to Google's terms and policies
  • AI-generated results may vary and are not guaranteed to meet your expectations

5.2 Data Processing

Your images are temporarily processed by third-party AI services and stored using third-party storage providers (Vercel Blob). We use reasonable security measures to protect your data, but cannot guarantee absolute security.

6. Intellectual Property

6.1 Service Ownership

The Service, including its software, design, text, graphics, and other content (excluding User Content and Generated Content), is owned by SketchViz and is protected by copyright, trademark, and other intellectual property laws.

6.2 Trademarks

SketchViz and related logos are trademarks of SketchViz. You may not use these trademarks without our prior written permission.

7. Disclaimers and Limitation of Liability

7.1 No Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, timely, secure, or error-free
  • The results obtained from using the Service will be accurate or reliable
  • Any errors in the Service will be corrected
  • The AI-generated images will meet your requirements or expectations

7.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SKETCHVIZ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of or inability to access or use the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorized access, use, or alteration of your transmissions or content

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

8. Indemnification

You agree to indemnify, defend, and hold harmless SketchViz and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your User Content or Generated Content

9. Modifications to the Service and Terms

9.1 Service Modifications

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

9.2 Terms Modifications

We may revise these Terms from time to time. The most current version will always be posted on our website. By continuing to use the Service after revisions become effective, you agree to be bound by the revised Terms.

10. Termination

You may stop using the Service at any time. We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be resolved in the courts of Poland.

12. General Provisions

12.1 Entire Agreement

These Terms constitute the entire agreement between you and SketchViz regarding the Service and supersede all prior agreements and understandings.

12.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

12.3 Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.

12.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign our rights and obligations without restriction.
